familyMEDIATION
Family Mediation is a process that assists separating or divorcing couples to resolve their disputes and negotiate their own decisions, taking into account the needs of all involved. An impartial third person, the mediator, helps those going through family breakdown by providing a safe environment for participants to communicate their needs while negotiating a consensual, informed agreement. The matters to be resolved can include financial and property issues and future arrangements for children. And both participants have equal decision-making authority.
More than the traditional court-based approach to family breakdown, mediation acknowledges that divorce is an emotional event as well as a legal one.
Mediators normally come from the legal or psychotherapeutic professions and are experienced in family law and in counselling.
We often advise co-mediation; the use of two mediators, one having a legal background and one from the counselling profession.
Some facts about mediation:
- Mediation is a voluntary process requiring the consent of both parties.
- Mediators are impartial and unbiased, ensuring fair negotiations.
